bush has the sole power to detain anyone (anywhere), for any reason he deems fit, and to further interpret what he thinks is torture if he wants to "aggressively interrogate" the captor. this is without precedent. lincoln only suspended habeas to preserve democracy.

the administration was doing it all already, illegally, but now it's been made law and all abuses have been retroactively pardoned. there is no check on the bulging power of a very dangerous executive branch.
