One of the weaknesses of Constitutional law is the executive branch (with some limitations and some congressional oversight) and the legislature is allowed to craft policy and law in the US code at will and the ultimate test of legality has to be done by the judicial system. By using legal counsel before issuing policy, the executive and legislative actors are doing due diligence on examination of policy within the context of current law and precedent. This due diligence is what covers their ass from prosecution when the law gets tested by the judiciary. Lawyers simply don't go to jail for incompetence, they can get disbarred for it though, case in point, Clinton's disbarment.
Obama knows this better than most and knows that while judicial investigation would gain his party significant political advantage, short of disbarring the incompetent legal counsel (including the appellate judge), nothing can be gained from this. It will destabilize transitions of political factions in the same way that executive confirmations have become. Because of the difficulty in faction transitions, the most effective administrations are those that have a big majority. Big majorities are not good democracy. Big factional majorities tend to gravitate towards reactionary and radical poles of political change models and are usually bad news for the citizen who has to absorb the large alterations in law.
In short: we don't want to add "prosecution wars" to "confirmation wars" when we move from blue to red to blue. It destabilizes the system when we already only spend 2 years of a 4 year term taking any policy risk in the first place.
When a politician fails to defend the Constitution in accordance with their oath of office, that does not bring with it a legal liability of prosecution. If that was so, it would be impossible to change the law.
